Referral Program Terms

These terms govern the WhaleFinders Partner and Referral Program. They apply to anyone who makes a referral to WhaleFinders LLC, whether as an independent partner or as an existing WhaleFinders client. By taking part you agree to these terms.

1. Who can take part

The program is not open to the general public. Every application is reviewed by hand and we accept two groups. The first is current and former WhaleFinders clients. The second is established figures in the OnlyFans management industry, meaning people and businesses with genuine standing among management agencies or creators, such as agency owners, operators, tooling and service providers, recognised consultants, and creators with a real audience. We decline applicants outside those two groups, and we may decline or remove any participant at our discretion, including where participation would create a conflict of interest or a reputational risk.

You may not make a referral for a business you own or control, for your own account, or through any identity that conceals your involvement.

There is no fee to join the program, no minimum volume, and nothing to buy. Taking part never requires a payment of any kind from you, and we will never ask you to purchase anything in order to participate or to be paid.

2. How a referral is attributed

A referral is attributed to you when the person you introduce reaches WhaleFinders through your Whop affiliate link and goes on to subscribe. Whop records that attribution and we pay on what Whop records.

We cannot pay on an introduction that Whop did not record. If you intend to introduce someone offline, tell us before you do it so we can agree in advance how it will be tracked.

We may decline a referral for anyone who was already an active lead with us before your introduction. Where two participants claim the same person or business, we decide on the evidence available to us, and our decision is final.

3. What counts as a qualifying referral

A qualifying referral is a person or business that is not you, is not controlled by you, and is not already a WhaleFinders client, which enters a paid WhaleFinders subscription through your Whop affiliate link. It may be a management agency, or a creator subscribing directly.

Adding creators, channels or plans to your own existing account is an expansion of that account, not a referral, and does not earn commission.

4. Commission

Commission is 20% of the subscription revenue WhaleFinders collects from the referred account, for every month in which that account pays (the "Commission Period"). There is no time limit and no step down.

Commission accrues from the referred account’s first paid month. Accrued commission is released to you under Section 5.

Commission is calculated on the subscription revenue WhaleFinders collects from the referred account, before our own payment processing costs. It excludes taxes, refunds, and any amount not collected.

Commission is never calculated on a creator’s earnings on OnlyFans or any other platform. WhaleFinders neither receives nor requests that data.

Commission continues for as long as the referred account keeps paying, and ends only when the account stops paying. If a referred account stops and later restarts, commission resumes on the same terms. Changing plan or adding creators does not affect it.

There is no limit on how many people you may refer. There is no second tier: you do not earn from referrals made by other participants.

5. Payment

Commission is tracked and paid through Whop, the platform that processes WhaleFinders subscriptions. To take part and to be paid you need a Whop account, which is free to create.

Commission on a payment is released after a holding period that allows for refunds and chargebacks. Once released it is credited to your Whop balance, and you withdraw it using the payout methods Whop supports in your country. The holding period, the payout methods, any minimum balance and any payout fees are set by Whop and are outside our control.

Commission is always paid in cash. We do not pay commission as account credit, as a discount against your own WhaleFinders invoices, or in any other form.

If Whop cannot pay you because your account is incomplete, unverified, restricted or closed, commission cannot be released to you by another route while that remains the case. You are responsible for keeping your Whop account in good standing and your payout details accurate. WhaleFinders is not liable for funds sent to details you supplied incorrectly.

Where we agree in writing to pay you outside Whop, payment is made monthly in arrears, within 15 days of the end of the month in which the underlying revenue was collected, and any balance we cannot deliver because we cannot reach you is handled in accordance with applicable unclaimed property law.

6. Existing WhaleFinders clients

Existing WhaleFinders clients may take part in the program on the same terms as anyone else. Commission is paid to you in cash on the standard schedule set out in Section 5, at the same rate and for the same Commission Period.

Commission is not applied as a credit against your own WhaleFinders invoices, and it does not reduce, offset, or delay any amount you owe us for your own subscription. The two are kept separate.

If your own subscription ends, commission on your referrals is unaffected and is still paid to you in cash on the standard schedule.

7. The welcome offer

Anyone arriving through an accepted referral receives one additional creator slot free for their first 30 days, on top of the plan they subscribe to. The free slot earns no commission while it is free. If they keep it as a paid slot afterwards, it is treated as part of the referred account and earns commission normally.

Referred clients pay the same published prices as everyone else. There is no referral surcharge.

8. Reversals

We reverse or withhold commission only where the underlying revenue is refunded or charged back, where a referral is found to be fraudulent, self-dealt or misattributed, or where you have breached these terms.

Commission is not reversed because a referred account cancels. Payments already released for months that were collected are yours to keep.

Where a reversal applies, the amount is deducted from your next payment or, if no payments remain, invoiced to you.

9. How you may promote WhaleFinders

You may introduce agencies and creators directly, tell your audience the program exists, share your referral code, and share our public materials.

You may not bid on WhaleFinders brand terms or close variants in paid search; send unsolicited bulk messages or automated outreach of any kind; present yourself as WhaleFinders or as an employee or agent of WhaleFinders; register domains, handles or accounts using our name; make claims about results, earnings or guarantees on our behalf; or promote WhaleFinders alongside sexually explicit material.

If you send any email promoting WhaleFinders you must comply with the CAN-SPAM Act, including accurate header information and subject lines, a valid physical postal address, a working unsubscribe mechanism honored within ten business days, and clear identification of the message as an advertisement where required. We may ask to review any email, landing page or creative that mentions WhaleFinders before it is sent, and may require you to stop using material that creates legal exposure for either of us.

WhaleFinders does not post content, does not manage creator accounts, and does not run chat. Do not describe our service as doing any of those things.

10. Disclosure

If you publicly endorse or promote WhaleFinders, you must clearly and conspicuously disclose that you are compensated for referrals, in the same place as the endorsement. This is required by the United States Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising, and is a condition of taking part.

You are responsible for complying with the advertising, consumer protection and disclosure laws that apply to you.

11. Non-circumvention

WhaleFinders will not solicit your clients for services outside the WhaleFinders subscription, and will not use an introduction you make to bypass you in your own commercial relationship with that party.

Nothing here restricts either party from continuing to deal with a business it already had a relationship with.

12. Taxes and independent status

You are responsible for your own taxes on any amount you receive. You are an independent party and not an employee, agent, partner or joint venturer of WhaleFinders, and you have no authority to bind WhaleFinders.

Because commission reaches you through Whop, the tax documentation and reporting required of a payer is handled by Whop under its own terms. Whop may ask you for a Form W-9 if you are a United States person, or a Form W-8BEN or W-8BEN-E if you are not, and may withhold where the law requires it.

Where we agree in writing to pay you outside Whop, we will collect that same documentation before your first payment and will not release a payment until we hold valid documentation. A Form W-8 expires at the end of the third calendar year after you sign it, so we will ask you to refresh it. Where United States law requires it we will report payments to you, and if you have not given us a valid taxpayer identification number we will apply backup withholding at the statutory rate.


13. Suspension and termination

Either party may leave the program at any time by written notice. If you leave, or if we close the program, commission on referrals that were already accepted at that time continues to be paid under the terms that applied when they were accepted, for as long as those accounts keep paying. This includes referrals that had not yet started paying when the program closed.

We may suspend or terminate your participation immediately, and withhold unpaid commission, where we reasonably believe you have breached these terms, acted fraudulently, or damaged the WhaleFinders brand.

14. Changes to the program

We may change these terms or the commission rate at any time. Changes apply only to referrals accepted after the change takes effect. Referrals already accepted keep the terms that applied when they were accepted.

15. No income promise and limitation of liability

Nothing in this program is a promise of income. Any figures shown on our website, including the earnings calculator, are illustrative and depend entirely on how many of the agencies and creators you introduce go on to subscribe, what they pay, and how long they stay.

To the maximum extent permitted by law, the total liability of WhaleFinders under these terms is limited to the commission properly due to you at the time the claim arises.

16. Sanctions

You represent, each time you make a referral and each time you receive a payment, that you are not on any list maintained by the United States Office of Foreign Assets Control or any equivalent authority, that you are not owned or controlled by any such person, and that you are not resident, located or organised in any jurisdiction subject to comprehensive United States sanctions. You will tell us immediately if that stops being true.

We screen participants and payment details against sanctions lists. We may delay, withhold or refuse any payment, and may suspend or end your participation, where screening returns a match or where making the payment would or might breach sanctions law. Where we are required to block or reject a payment we will do so and report it as the law requires, and we will not be liable to you for it. Time limits for payment in these terms do not run while a payment is held under this section.

17. Confidentiality

Where we decline a referral because that agency or creator is already recorded in our pipeline, the fact of that record is confidential and you may not use or disclose it. We treat any details you give us about someone you introduce as confidential, and use them only to assess and service that referral. Each party will protect the other party's non-public information with reasonable care and will not use it for any purpose outside this program.

18. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. Any dispute arising from them will be brought in the state or federal courts located in Wyoming. Where you are also a WhaleFinders customer and a dispute concerns both your subscription and this program, Section 20 of our Terms & Conditions governs that dispute. Nothing in these terms removes or limits any right you have under the consumer law of the country where you live that cannot be excluded by contract.
