WhaleFinders Acceptable Use Policy

This Acceptable Use Policy sets out what you may and may not do when you use WhaleFinders and the direction we provide. It applies to WhaleFinders LLC ("WhaleFinders", "we", "us"), a Wyoming limited liability company, and to our business customers, who are OnlyFans management agencies. It forms part of, and should be read alongside, our Terms & Conditions. On matters of permitted and prohibited use, this policy governs; on all other matters, the Terms govern. By using our service you agree to this policy, and you agree to make sure that everyone who acts on your behalf, including your staff, your contractors, and the creators you represent, follows it too.

1. What we do, and what you are responsible for

WhaleFinders provides marketing direction. We create strategy, content direction, setup and safety guidance, and ongoing recommendations that your own team acts on. We do not produce content, post on your behalf, run chats or messages, operate bots, buy traffic, or contact your creators. Everything we provide is direction, and you and your team are responsible for how you carry it out. That means you are responsible for what is actually posted, for following the law, and for following the rules of every platform you use. Nothing in our direction removes your duty to act lawfully and within those platform rules.

2. Lawful use

You may use our service and our direction only for lawful purposes. You may not use anything we provide to plan, support, or carry out activity that is illegal, fraudulent, deceptive, harassing, abusive, or harmful to others. You are responsible for knowing and following the laws that apply to you and to the creators you represent, wherever they are based.

3. Everyone must be an adult

Every creator you represent, and every person who appears in any content you market using our direction, must be at least eighteen years old and must meet the minimum age and verification rules of each platform they appear on. You are responsible for verifying this and for keeping the records the law requires. Because we provide strategic direction only, and do not film, select, edit, manage, host, or publish any content, WhaleFinders is not the producer of that content for any legal purpose, including United States age-verification and record-keeping law; responsibility for those obligations sits with you and your creators, as the law allocates it between you, and never with WhaleFinders. You must be able to show, if the law requires it, that everyone involved is an adult who is taking part willingly.

4. Content that is never allowed

Some things are never acceptable, and there are no exceptions. You may not use our service or our direction in connection with any sexual content involving a minor, or anyone who appears to be a minor; any content that is not fully consensual, including so-called revenge content, hidden-camera content, and fabricated or face-swapped content of a real person made without their consent; or any content connected to human trafficking, coercion, blackmail, or exploitation of any kind. You may not use our service in connection with any other content that is illegal in the places where it is created or shown. If we become aware of any of this, we will stop work immediately, end your access, and we may report it to the relevant authorities without telling you first.

5. Following each platform's own rules

Our direction covers platforms such as OnlyFans, Reddit, Instagram, TikTok, and X, among others. You must follow the terms of service and community rules of every platform you use, and you alone are responsible for doing so. You may not use our direction to get around those rules. That includes evading a ban or opening new accounts after one, faking engagement such as buying or automating likes, follows, views, or votes, running undisclosed automation or bots, manipulating a platform's ranking or recommendation systems, or any other attempt to deceive a platform or its users. We give guidance on setting up and growing accounts safely, but our direction is not a promise that any particular tactic complies with a platform's current rules, which the platforms set and change on their own.

6. Spam and fake activity

You may not use our direction to send spam or bulk unsolicited messages, to create or operate fake or mass-registered accounts, to run bots or scripts that imitate real people, or to inflate any metric artificially. If any of your outreach includes email, you must follow the laws that apply to commercial email, including using accurate sender and subject information, a valid physical address, and a working way to opt out that you honor promptly. Growth must come from real content reaching real audiences, carried out within each platform's rules.

7. Our materials and your confidentiality obligations

Everything we deliver, including briefs, guides, personas, niche research, calendars, and any other materials, is provided for your own internal use in running your agency. You may not resell, sublicense, republish, or redistribute our materials, or pass them to anyone outside your agency, and you may not reverse engineer them or use them to build a competing service. Because we work as a white-label part of your team, you may present our deliverables to your creators as your own work. You must keep our methods, materials, and pricing confidential, and you must not republish them or identify them as ours to third parties. In turn, we will not contact your creators, will not identify ourselves to them, and will not name your agency publicly without your written consent.

8. Our website and systems

You may not interfere with, or try to gain unauthorized access to, our website, our delivery channels, or any system we use. That includes attempting to break or overload them, scraping them, introducing malware, or testing their security without our written permission.

9. No guarantee of results, and no guarantee of platform safety

WhaleFinders provides direction and strategy, not outcomes. We do not guarantee any specific growth, revenue, follower count, subscriber count, or other result, because those depend on your team's execution, each creator's content, and conditions we do not control. Following our direction, and even following a platform's rules carefully, does not guarantee that a platform will not restrict, limit, suspend, or remove an account. Platforms act at their own discretion and change their rules without notice, and we are not responsible for the decisions they make.

10. Sanctions and trade restrictions

You confirm that you, your business, and the people you represent are not located in, or acting on behalf of, any country, group, or person subject to sanctions or trade restrictions under United States or other applicable law, and that you will not use our service in breach of those laws. We may decline or end service to anyone we reasonably believe falls within those restrictions.

11. Reporting a concern

If you become aware of anything that breaks this policy, or of any content or conduct involving a minor, a person who has not consented, or exploitation of any kind, please tell us straight away. You can contact us through our Contact page or at admin@whalefinders.com, and we will take it seriously.

12. What happens if this policy is breached

We may decide, at our sole discretion and with or without notice, to refuse to start work, to pause or suspend the service, or to end your access entirely if we believe this policy has been broken. Where we end the service because of a breach, any fees you have already paid are not refundable, in line with our Payment & Refund Policy, and we may take any other step the law allows, including recovering our costs and cooperating with law enforcement. The parts of this policy that protect us, including the prohibitions, your responsibilities, and the disclaimers, continue to apply even after the service ends.

13. Changes to this policy

We may update this policy from time to time as our service, the platforms we work with, or the law change. When we make a material change we will revise the "Last updated" date at the top, and continuing to use the service after a change takes effect means you accept it.
