This DMCA and Copyright Policy explains how WhaleFinders LLC ("WhaleFinders", "we", "us"), a Wyoming limited liability company, handles claims of copyright infringement, and what we expect of our customers. It forms part of, and should be read alongside, our Terms & Conditions and our Acceptable Use Policy. We respect the intellectual property of others, and we ask the same of everyone who uses our service.

1. What this policy covers

This policy applies to material on our own website at whalefinders.com and to the written materials we deliver to customers, such as our guides, briefs, and other deliverables. It also sets out the copyright commitments we require from our customers. We follow the notice and takedown process of the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. 512, for material that is within our control.

2. We do not host the content you create or post

WhaleFinders provides marketing direction only. We do not create, host, store, publish, or post the photos, videos, or other content that creators produce or that agencies and creators publish on platforms such as OnlyFans, Reddit, Instagram, TikTok, and X. That content lives on those platforms and on our customers' own accounts, not on our systems. If your copyright concern is about content posted on one of those platforms, please use that platform's own copyright or DMCA reporting process, because we are not able to remove content we do not host. This policy is for material that is actually on our website or in the materials we ourselves provide.

3. Your copyright obligations to us

You must not use our service or our direction to copy, reproduce, distribute, or pass off anyone else's copyrighted work, trademarks, or other intellectual property without the right to do so. You are responsible for holding all rights, licenses, consents, and releases needed for the content you create and market. Using our materials to infringe someone else's rights is a breach of this policy, of our Terms & Conditions, and of our Acceptable Use Policy.

4. How to send us a copyright notice

If you believe in good faith that material on our website or in our materials infringes a copyright you own or are authorized to act for, you may send us a written notice. To be effective under the DMCA, your notice must include all of the following: a physical or electronic signature of the copyright owner or a person authorized to act for them; identification of the copyrighted work you say has been infringed; identification of the material you say is infringing and enough information for us to locate it, such as the page address; your name, address, telephone number, and email address; a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law; and a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

5. Where to send your notice

Please send copyright notices to our designated contact for copyright matters, WhaleFinders LLC, a Wyoming limited liability company, by email at admin@whalefinders.com or through our Contact page, with "DMCA Notice" in the subject. Please use the subject line "DMCA Notice" so we can route your notice quickly.

6. What we do when we receive a valid notice

When we receive a notice that meets the requirements above for material within our control, we will act expeditiously to remove or disable access to that material. If the material appears in a brief or other deliverable we have already provided to a customer, we will correct or withdraw the affected deliverable, ask the customer to stop using the affected part, and we may give the customer a copy of the notice.

7. Counter-notification

If your material was removed or disabled and you believe this was a mistake or a misidentification, you may send us a counter-notification. To be effective, it must include your physical or electronic signature; identification of the material that was removed and the location where it appeared before it was removed; a statement, made under penalty of perjury, that you believe in good faith the material was removed as a result of mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal court for the district where you live, or, if you live outside the United States, for any district in which we may be found, and that you will accept service of process from the person who gave the original notice or their agent. Send counter-notifications to the same contact in Section 5. As the law allows, we may restore the material in a reasonable time unless the original complainant tells us they have filed a court action.

8. Repeat infringers

We will, in appropriate circumstances and at our discretion, suspend or end the service of any customer we find to be a repeat infringer of copyright, in line with our Terms & Conditions and our Acceptable Use Policy.

9. Trademarks and other intellectual property

We respect trademarks and other intellectual property in the same way. The names of platforms such as OnlyFans, Reddit, Instagram, TikTok, and X belong to their respective owners and are used only to identify those platforms. We are not affiliated with, endorsed by, or sponsored by any of them. If you have a trademark or other intellectual property concern about material on our website or in our materials, please contact us using the details in Section 5.

10. False claims

Please be careful and act in good faith. Under the DMCA, anyone who knowingly makes a material misrepresentation in a copyright notice or a counter-notification, for example by claiming that material is infringing when it is not, may be liable for damages, including costs and legal fees.

11. Changes and contact

We may update this policy from time to time, and when we make a material change we will revise the "Last updated" date at the top.
