

Referral Program Terms

These terms govern the WhaleFinders Partner and Referral Program. They apply to anyone who registers a referral with WhaleFinders LLC, whether as an independent partner or as an existing WhaleFinders client. By registering a referral you agree to these terms.
1. Who can take part
The program is open to businesses and individuals able to introduce OnlyFans management agencies, or creators running their own page, to WhaleFinders. Existing WhaleFinders clients may also take part. We may decline or remove any participant at our discretion, including where participation would create a conflict of interest or a reputational risk.
You may not register a referral for a business you own or control, for your own account, or through any identity that conceals your involvement.
There is no fee to join the program, no minimum volume, and nothing to buy. Taking part never requires a payment of any kind from you, and we will never ask you to purchase anything in order to participate or to be paid.
2. Registering a referral
A referral must be registered with WhaleFinders before you introduce the agency to us. Registration requires the agency name and a named contact.
We check every registration against our existing pipeline and respond within one business day. A registration is declined if the agency is already an active lead recorded with us within the previous 90 days. Where a recorded lead has been dormant for more than 90 days, we will honor your registration.
An accepted registration is valid for 90 days. If they have not entered a paid subscription within that period the claim lapses, and may be registered again subject to the same checks. Where two participants register the same person or business, the earlier timestamped registration prevails.
A referral code is issued automatically when you complete the signup form. Issuing a code is not approval of any particular referral and does not by itself register anyone. Registration under this section is what creates a claim.
3. What counts as a qualifying referral
A qualifying referral is a person or business that is not you, is not controlled by you, and is not already a WhaleFinders client, which enters a paid WhaleFinders subscription and pays for at least two consecutive months. It may be a management agency, or a creator subscribing directly.
Adding creators, channels or plans to your own existing account is an expansion of that account, not a referral, and does not earn commission.
4. Commission
Commission is 20% of the subscription revenue WhaleFinders actually collects from the referred account, for the first twelve months of that account’s paid subscription.
Commission accrues from the referred account’s first paid month. The first payment is released after the referred account’s second consecutive month has been collected and covers both months. Payments are monthly after that.
Commission is calculated on net subscription revenue received by WhaleFinders. It excludes taxes, transaction fees, refunds, credits, and any amount not collected.
Commission is never calculated on a creator’s earnings on OnlyFans or any other platform. WhaleFinders neither receives nor requests that data.
After the twelfth month of the referred account’s paid subscription, commission on that account ends. It does not restart if the referred account changes plan, pauses, or resubscribes.
There is no limit on how many people you may refer. There is no second tier: you do not earn from referrals made by other participants.
5. Payment
Payments are made monthly in arrears, within 15 days of the end of the month in which the underlying revenue was collected, by USDC or bank transfer.
A minimum balance of US$100 applies. Balances below that amount roll forward until the threshold is met, or until the referral period ends, at which point any remaining balance is paid in full regardless of size.
If we cannot reach you, or you do not supply valid payment details, any balance owed to you is held and then handled in accordance with applicable unclaimed property law. We will make reasonable attempts to contact you at the address you gave us before that happens.
You are responsible for providing accurate payment details. WhaleFinders is not liable for funds sent to details you supplied incorrectly.
6. Credit instead of cash for existing clients
Existing WhaleFinders clients receive commission as a credit against their own WhaleFinders invoices by default, at the same rate and for the same twelve months. Credit is applied automatically to the next invoice and shown as a separate line.
Credit cannot be transferred and cannot be exchanged for a refund of amounts already paid. Where credit exceeds the invoice, the excess rolls forward to later invoices.
If your subscription ends while commission months remain, the remaining eligible months are paid to you in cash on the standard schedule.
You may elect cash instead of credit at any time by telling us in writing. The rate does not change.
7. The welcome offer
Anyone arriving through an accepted referral receives one additional creator slot free for their first 30 days, on top of the plan they subscribe to. The free slot earns no commission while it is free. If they keep it as a paid slot afterwards, it is treated as part of the referred account and earns commission normally.
Referred clients pay the same published prices as everyone else. There is no referral surcharge.
8. Reversals
We reverse or withhold commission only where the underlying revenue is refunded or charged back, where a referral is found to be fraudulent, self-dealt or misregistered, or where you have breached these terms.
Commission is not reversed because a referred account cancels. Payments already released for months that were collected are yours to keep.
Where a reversal applies, the amount is deducted from your next payment or, if no payments remain, invoiced to you.
9. How you may promote WhaleFinders
You may introduce agencies and creators directly, tell your audience the program exists, share your referral code, and share our public materials.
You may not bid on WhaleFinders brand terms or close variants in paid search; send unsolicited bulk messages or automated outreach of any kind; present yourself as WhaleFinders or as an employee or agent of WhaleFinders; register domains, handles or accounts using our name; make claims about results, earnings or guarantees on our behalf; or promote WhaleFinders alongside sexually explicit material.
If you send any email promoting WhaleFinders you must comply with the CAN-SPAM Act, including accurate header information and subject lines, a valid physical postal address, a working unsubscribe mechanism honored within ten business days, and clear identification of the message as an advertisement where required. We may ask to review any email, landing page or creative that mentions WhaleFinders before it is sent, and may require you to stop using material that creates legal exposure for either of us.
WhaleFinders does not post content, does not manage creator accounts, and does not run chat. Do not describe our service as doing any of those things.
10. Disclosure
If you publicly endorse or promote WhaleFinders, you must clearly and conspicuously disclose that you are compensated for referrals, in the same place as the endorsement. This is required by the United States Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising, and is a condition of taking part.
You are responsible for complying with the advertising, consumer protection and disclosure laws that apply to you.
11. Non-circumvention
WhaleFinders will not solicit your clients for services outside the WhaleFinders subscription, and will not use an introduction you make to bypass you in your own commercial relationship with that party.
Nothing here restricts either party from continuing to deal with a business it already had a relationship with.
12. Taxes and independent status
You are responsible for your own taxes on any amount you receive. You are an independent party and not an employee, agent, partner or joint venturer of WhaleFinders, and you have no authority to bind WhaleFinders.
We may require tax documentation before making a payment, including a Form W-9 from United States persons or a Form W-8BEN or W-8BEN-E from persons outside the United States. Payments may be withheld until valid documentation is provided.
Credit applied against your own WhaleFinders invoice is a discount rather than a payment to you, and is not reported as income by WhaleFinders.
13. Suspension and termination
Either party may leave the program at any time by written notice. If you leave, or if we close the program, commission already accrued on qualifying referrals continues to be paid for the remainder of the twelve month period.
We may suspend or terminate your participation immediately, and withhold unpaid commission, where we reasonably believe you have breached these terms, acted fraudulently, or damaged the WhaleFinders brand.
14. Changes to the program
We may change these terms or the commission rate at any time. Changes apply only to referrals registered after the change takes effect. Referrals already accepted keep the terms that applied when they were registered.
15. No income promise and limitation of liability
Nothing in this program is a promise of income. Any figures shown on our website, including the earnings calculator, are illustrative and depend entirely on how many agencies subscribe, what they pay, and how long they stay.
To the maximum extent permitted by law, the total liability of WhaleFinders under these terms is limited to the commission properly due to you at the time the claim arises.
16. Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. Any dispute arising from them will be brought in the state or federal courts located in Wyoming.
